Obowiązek finansowania lekcji religii w polskim porządku prawnym

Abstract

The article addresses the obligation to finance religion classes through the state budget. The author examines the Polish legal system regarding the validity and justification of the constitutional obligation to fund religion classes with public funds. The article discusses the actual nature and scope of this obligation based on an analysis of legal provisions (constitutional regulations, international agreements, statutes, and ordinances) as well as case law of both the Constitutional Tribunal and the European Court of Human Rights.

Tematem artykułu jest problematyka obowiązku finansowania lekcji religii ze środków budżetu państwa. Autor analizuje polski porządek prawny pod kątem prawidłowości i zasadności istnienia konstytucyjnego obowiązku finansowania lekcji religii ze środków publicznych. Artykuł traktuje o rzeczywistym kształcie i zakresie wyżej wymienionego obowiązku w oparciu o analizę przepisów (regulacji konstytucyjnych, umów międzynarodowych, ustaw i rozporządzeń) oraz orzecznictwa zarówno Trybunału Konstytucyjnego, jak i Europejskiego Trybunału Praw Człowieka.
