Prawo korzystania z nieruchomości wakacyjnej jako przedmiot obrotu na polskim rynku turystycznym – aspekty prawno-ekonomiczne
Streszczenie
Main motivations that lead to the purchase of real property, including real
estate dedicated to leisure use are expectations to profit from its ownership or
intangible benefits. Real Estate Homes for several decades became an object of
desire of consumers around the world, being a sign of prestige and bearing
strong load of lifestyle. However, due to its high prices, their availability is
limited, not only in Poland but also worldwide. Timeshare property market in
Poland stopped in development despite its financial attractiveness. From the
perspective of the buyer the greatest disadvantage is the need to bind a contract
for several years and having holidays in the same place. In today's incredibly
dynamic times fashion is changing fast, so it is difficult to decide on the contract,
which will be valid for a period of 25 years. An additional barrier to the
development was detrimental to the buyers of the agreements, which meant that
the opinion about the timeshare became moderately positive. To protect
consumers, both the European and Polish legislator introduced numerous
restrictions on the timeshare contracts.
The paper analyses legal and economic aspects of timeshare “right to use”
from the perspective of the European market.
