References to Violence and War in the Process of Shaping the Concept of Natural Rights

Abstract

The article attempts to analyse the selected doctrines of natural rights from the perspective of references to the problem of violence. The first part takes into account late medieval consideration, as part of which the first conceptions of natural rights were formulated. In the deliberations of thinkers of this period, violence allows to argue in favour of certain conceptions. The second part depicts violence as a direct impetus shaping intellectual pursuits of the representatives of the School of Salamanca. The last part refers to Hobbes’ and Locke’s doctrines, in which violence is already an inherent component used in the framing of the natural rights conception, which involves, among other things, the formulation of certain visions of human nature.

W artykule podjęta została próba analizy wybranych doktryn uprawnień naturalnych z pespektywy odniesień do problemu przemocy. W pierwszej części zwrócona została uwaga na późnośredniowieczne rozważania, w ramach których wyartykułowane zostają pierwsze koncepcje uprawnień naturalnych. W rozważaniach myślicieli tego okresu przemoc pozwala argumentować na rzecz określonych koncepcji. W drugiej części ukazana została przemoc jako bezpośredni impuls kształtujący intelektualne poszukiwania przedstawicieli Szkoły z Salamanki. W ostatniej części przywołane zostają doktryny Hobbesa i Locke’a, w których przemoc jest już integralnym elementem budowania koncepcji uprawnień naturalnych, co wiąże się m.in. z formułowaniem określonych wizji natury ludzkiej.
