The aim of this article is to present a broad interpretation of the American Civil War, as promulgated by one of the most modern dominant historical and research schools. The article attempts to consolidate the assumptions and conclusions of neo-abolitionist and nationalist (unionist) historical interpretations. The article unifies entire trend, defining it as the Righteous Cause Myth, and indicates its ideological and socio-political sources that are the basis of its analyses of the American history.; Celem artykułu jest przedstawienie szerokiej interpretacji wojny secesyjnej w Stanach Zjednoczonych, jaką głosi jedna z najbardziej dominujących współcześnie szkół historyczno-badawczych zajmujących się tematyką tego okresu. Artykuł podejmuje próbę skonsolidowania założeń i wniosków neo-abolicjonistycznej oraz nacjonalistycznej (unionistycznej) interpretacji historycznej. W artykule dokonano ujednolicenia całego nurtu określając go mianem mitu Sprawiedliwej Sprawy i wskazano źródła ideologiczne oraz nurty polityczne, które stanowią podstawę jego analiz dotyczących historii Stanów Zjednoczonych.

<description>References to Violence and War in the Process of Shaping the Concept of Natural Rights

The article attempts to analyse the selected doctrines of natural rights from the perspective of references to the problem of violence. The first part takes into account late medieval consideration, as part of which the first conceptions of natural rights were formulated. In the deliberations of thinkers of this period, violence allows to argue in favour of certain conceptions. The second part depicts violence as a direct impetus shaping intellectual pursuits of the representatives of the School of Salamanca. The last part refers to Hobbes’ and Locke’s doctrines, in which violence is already an inherent component used in the framing of the natural rights conception, which involves, among other things, the formulation of certain visions of human nature.; W artykule podjęta została próba analizy wybranych doktryn uprawnień naturalnych z pespektywy odniesień do problemu przemocy. W pierwszej części zwrócona została uwaga na późnośredniowieczne rozważania, w ramach których wyartykułowane zostają pierwsze koncepcje uprawnień naturalnych. W rozważaniach myślicieli tego okresu przemoc pozwala argumentować na rzecz określonych koncepcji. W drugiej części ukazana została przemoc jako bezpośredni impuls kształtujący intelektualne poszukiwania przedstawicieli Szkoły z Salamanki. W ostatniej części przywołane zostają doktryny Hobbesa i Locke’a, w których przemoc jest już integralnym elementem budowania koncepcji uprawnień naturalnych, co wiąże się m.in. z formułowaniem określonych wizji natury ludzkiej.

The proliferation of private military companies (PMCs) challenges the state-centric international legal system, enabling states to use proxies while maintaining plausible deniability. This paper deconstructs that legal and political fiction, aiming to identify and analyze existing pathways to accountability for PMC misconduct under international law. The analysis focuses on two primary legal avenues: state attribution under the International Law Commission’s (ILC) Articles on State Responsibility (ARSIWA) and corporate criminal liability. It demonstrates that these legal frameworks are fraught with difficulties, including a deep jurisprudential divide between the ICJ and ICTY on attribution standards and significant procedural hurdles for corporate prosecution. The Wagner Group serves as a case study. This study concludes that the core problem is not a legal vacuum, but rather a “compliance vacuum,” where states deliberately avoid their obligations. Overcoming this will require a more robust application of the law.; Proliferacja prywatnych firm wojskowych (PMC) stanowi wyzwanie dla zorientowanego na państwo międzynarodowego systemu prawnego, umożliwiając państwom korzystanie z usług pełnomocników przy jednoczesnym zachowaniu wiarygodnego zaprzeczenia. Niniejszy artykuł dekonstruuje tę fikcję prawną i polityczną, dążąc do zidentyfikowania i przeanalizowania istniejących ścieżek odpowiedzialności za niewłaściwe postępowanie PMC na gruncie prawa międzynarodowego. Analiza koncentruje się na dwóch głównych drogach prawnych: przypisaniu odpowiedzialności państwu na mocy Artykułów Międzynarodowej Komisji Legislacyjnej (ARSIWA) oraz odpowiedzialności karnej korporacji. Pokazuje, że te ramy prawne są obarczone wieloma trudnościami, w tym głębokim podziałem jurysprudencji między MTS a MTKJ w zakresie standardów atrybucji oraz znacznymi przeszkodami proceduralnymi w ściganiu przedsiębiorstw. Grupa Wagnera stanowi studium przypadku. Niniejsze badanie dowodzi, że zasadniczym problemem nie jest próżnia prawna, lecz raczej „próżnia zgodności”, w której państwa celowo unikają swoich zobowiązań. Przezwyciężenie tego problemu będzie wymagało bardziej rygorystycznego stosowania prawa.

This paper aims to show that despite the fact that Hobbes used the term “civil war” several times in his Leviathan, if his theory is to be seen as an attempt to formulate a complete, logically consistent structure, then there is no place in it for any distinctive, analytically important feature that clearly separates civil war from ordinary war. This point subsequently serves to highlight the fact that Hobbes could separate the two types of conflict solely by implicitly relying on a common, standard usage of the term “civil war,” which in turn invalidated his claim regarding the presence of a universally recognized, unifying sovereign power as a sole ground of the existence of political community.; Niniejszy artykuł ma na celu wykazanie, że pomimo faktu, iż Hobbes kilkakrotnie użył terminu „wojna domowa” w dziele Lewiatan, jeśli jego teoria ma być próbą sformułowania kompletnej, spójnej, logicznej struktury, to nie ma w niej miejsca na żadną charakterystyczną, istotną analitycznie cechę, która wyraźnie odróżnia wojnę domową od zwykłej wojny. Ta obserwacja służy następnie podkreśleniu, że Hobbes był w stanie dokonać rozróżnienia między dwoma rodzajami konfliktu wyłącznie opierając się na powszechnym, standardowym rozumieniu terminu „wojna domowa”, co z kolei podważało jego twierdzenie dotyczące obecności powszechnie uznanej, jednoczącej władzy suwerennej jako jedynej podstawy istnienia wspólnoty politycznej.
